Terms of Service & Acceptable Use Policy

These Terms of Service govern your access to and use of ITN PROXY routing networks, developer APIs, and software infrastructure. Please read them carefully.

1. Acceptance of Terms

By registering for, accessing, purchasing, or utilizing any proxy routing network, API, customer dashboard, or software service provided by ITN PROXY ("Company", "we", "us", or "our"), you ("User", "Customer", "Client", or "you") agree to be bound by these Terms of Service ("Terms"), our Privacy Policy, and our Cookie Policy.

If you are using these services on behalf of an organization or corporate entity, you represent and warrant that you have full legal authority to bind such entity to these Terms. If you do not agree to every provision contained herein, you must immediately discontinue all access and use of ITN PROXY services. Continued access or usage represents unconditional acceptance.

2. Neutral Intermediary Status & Absolute Limitation of Liability

Zero Liability

2.1 Technical Conduit Status: ITN PROXY operates strictly as a neutral, technical data transmission conduit and protocol forwarding intermediary. ITN PROXY does not originate, curate, modify, inspect in real time, or endorse the payload content transmitted through its network nodes.

2.2 Total Limitation of Liability: To the maximum extent permitted by applicable law, under no circumstances shall ITN PROXY, its owners, directors, officers, employees, contractors, node suppliers, or affiliates be liable for: - Any direct, indirect, incidental, punitive, special, exemplary, or consequential damages; - Any loss of profits, loss of data, loss of business goodwill, server downtime, or service interruptions; - Target website IP bans, rate limiting, CAPTCHA challenges, Cloudflare/Datadome blocks, or access restrictions imposed by third-party servers; - Any financial loss, civil penalties, or criminal liabilities resulting from your web scraping, automated browsing, data extraction, or network traffic; - Any dispute, copyright infringement claim, or litigation initiated against you by target servers, third parties, or regulatory bodies.

2.3 "AS-IS" and "AS-AVAILABLE" Warranty Disclaimer: All proxy pools, network routing ports, and bandwidth allocations are provided strictly on an "AS-IS" and "AS-AVAILABLE" basis, without warranties of any kind, whether express, implied, statutory, or otherwise, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted availability.

3. User Indemnification & Hold Harmless

User Indemnity

You agree to fully defend, indemnify, and hold harmless ITN PROXY, its parent companies, subsidiaries, directors, officers, employees, agents, and licensors from and against any and all claims, demands, liabilities, damages, judgments, losses, costs, expenses, and reasonable attorney fees arising out of or related to: 1. Your use, misuse, or configuration of the proxy network, APIs, or bandwidth; 2. Any data transmitted, queried, crawled, scraped, or extracted through ITN PROXY endpoints; 3. Any breach of these Terms, Acceptable Use Policies, or applicable local and international laws; 4. Any infringement or violation of third-party intellectual property rights, privacy rights, computer fraud statutes, or target website terms of service.

ITN PROXY reserves the right, at your sole expense, to assume the exclusive defense and control of any legal proceeding otherwise subject to indemnification by you.

4. Strict Acceptable Use Policy (Zero Tolerance for Cybercrime)

Strictly Prohibited

ITN PROXY strictly prohibits any illegal, abusive, malicious, or non-consensual use of its network infrastructure. There is ZERO TOLERANCE for cybercrime and malicious activity.

The following activities are strictly prohibited and will result in immediate, permanent account termination without refund, permanent IP blacklisting, and instant escalation to law enforcement authorities: - Cyberattacks & Disruption: Distributed Denial of Service (DDoS/DoS), SYN floods, botnet command & control, vulnerability probing, port scanning, SQL injections, zero-day exploitation, or automated brute-force attacks. - Credential Stuffing & Account Takeover: Automated password spraying, credential stuffing, or unauthorized login attempts on third-party authentication systems. - Financial Fraud & Abuse: Carding, payment fraud, identity theft, credit card validation tests, scam portals, cryptocurrency wallet draining, or ad click fraud. - Phishing & Social Engineering: Distributing, hosting, or facilitating phishing pages, deceptive landing pages, malware, ransomware, spyware, or malicious payloads. - Spamming & Harassment: Unsolicited mass email (UCE/SPAM), bulk SMS abuse, automated social media harassment, brigading, or mass deceptive registrations. - Copyright Infringement & Piracy: Torrenting, unauthorized distribution of copyrighted media, bypassing digital rights management (DRM), or non-compliant automated mass copyright infringement. - Severe Crimes & CSAM: Any generation, access, dissemination, or facilitation of Child Sexual Abuse Material (CSAM), terrorism, violent extremism, or hate crimes.

5. Mandatory Domain Blacklist (.gov & Banking Domains Strictly Blocked)

Network Blocklist

To safeguard critical public infrastructure and prevent financial fraud, ITN PROXY enforces a hard-coded, automated network-level domain blocklist:

5.1 Government & Military Blacklist: - All top-level and second-level government domains including but not limited to .gov, .gov.tr, .gov.uk, .mil, .police.uk, .jud.ct.gov, and associated ministerial, judicial, municipal, defense, intelligence, and emergency response portals are strictly blocked at the gateway router. - Any proxy traffic attempting to connect to government IP ranges is automatically dropped.

5.2 Banking & Financial Institutions Blacklist: - All retail, commercial, and investment banking portals, online banking gateways, mobile banking API backends, and core financial services are strictly blocked. - Payment gateway interfaces (e.g., Stripe, PayPal, Square backends when targeted for automated card validation) and centralized cryptocurrency withdrawal endpoints are strictly restricted.

5.3 Prohibition of Bypass: Any attempt to bypass, tunnel through, spoof SNI headers, or circumvent this filter via custom DNS tunneling or IP encapsulation is a material breach of contract and will trigger immediate account termination and legal reporting.

6. Law Enforcement Cooperation & Direct Log Disclosure

Legal Compliance

6.1 Absolute Cooperation: ITN PROXY complies fully, directly, and unconditionally with all lawful requests, court orders, subpoenas, judicial warrants, prosecutor inquiries, and official directives from authorized law enforcement and cybercrime investigation agencies.

6.2 Direct Disclosure Without Notice: When presented with a valid legal request or official government notice regarding criminal activities: - ITN PROXY will immediately and directly hand over all requested connection logs, account details, registered email addresses, billing transaction IDs, source IP addresses, assigned proxy IPs, connection timestamps, destination hostnames, and port routing records. - ITN PROXY is under no obligation to notify you prior to or following such disclosures. You explicitly waive any right to privacy, confidentiality, or claims against ITN PROXY concerning disclosures made to official state authorities.

7. Mandatory 5-Year Log & Connection Data Retention

5-Year Retention

In accordance with applicable telecommunications regulations, internet service provider compliance laws, and cybersecurity audit standards: - ITN PROXY stores and archives all connection logs, timestamp records, source IP addresses, proxy endpoint assignments, port translations, authentication events, and billing history for a mandatory period of five (5) years (60 months). - These records are preserved in secure, encrypted storage specifically for regulatory compliance, security incident forensics, and authorized law enforcement investigations. - General data erasure requests (such as GDPR Article 17 "right to be forgotten") do not apply to mandatory statutory cybersecurity retention logs required by law for public order and criminal investigations.

8. Billing, Payments & Non-Refundable Policy

8.1 Digital Asset Nature: Proxy bandwidth and dedicated IP allocations are intangible digital services consumed in real time upon activation.

8.2 Non-Refundable Policy: Due to the operational cost of reserving residential and datacenter subnets, all purchases, top-ups, and subscriptions are strictly non-refundable. No refunds or credits will be issued for unused bandwidth, target-side rate limits, or accounts terminated due to Acceptable Use Policy violations.

8.3 Fraudulent Chargebacks: Any unauthorized chargeback or payment dispute will result in immediate permanent account termination, forfeiture of remaining data, and placement of billing details onto anti-fraud registries.

9. Account Suspension & Termination

ITN PROXY reserves the unilateral right to suspend, restrict, throttle, or terminate your account immediately, without prior notice or liability, if: 1. You violate any provision of these Terms or the Acceptable Use Policy; 2. Abnormal traffic patterns indicating cyberattacks, credential stuffing, or brute force are detected; 3. An official directive or inquiry is received from a law enforcement or judicial agency; 4. You attempt to access restricted government (.gov) or banking infrastructure; 5. You engage in payment fraud or abusive behavior toward support staff.

Upon termination, all remaining bandwidth, credits, and access tokens are forfeited without compensation.

10. Governing Law & Severability

These Terms and any disputes arising out of or related to ITN PROXY services shall be governed by and construed in accordance with applicable commercial and cybersecurity laws.

If any provision of these Terms is found to be unlawful, void, or unenforceable by a court of competent jurisdiction, that provision shall be deemed severable and shall not affect the validity and enforceability of any remaining provisions.
